Ahmedabad, 29 August: The Gujarat High Court has ordered the Gujarat Medical Council to take action against Dr. Rajesh Sangani for issuing fake medical certificates without examining the accused murderer and to help him obtain bail.
Dr. Rajesh Sangani is a cardiologist practicing in Keshod, Gujarat. According to reports, Dr. Rajesh issued a false medical certificate to Faruq Maulana.
Faruq Maulana worked as a transporter in Veraval. He is accused of murder and extortion. Dr. Rajesh Sangani is being accused of issuing false medical certificates to Faruq. He issued certificates on June 3 and June 19.
Maulana submitted a bail application in Veraval Sessions Court, where he presented the jury with both certificates. However, the court observed that Maulana, who was serving his time in prison, was never examined before these certificates were issued, making them invalid.
During additional sessions, Judge JJ Pandya issued a notice to Dr. Rajesh asking him to explain the false certificates. The Judge asked how Dr. Rajesh issued medical certificates about Maulana’s health without examining him, because the information given in the certificates was obtained by his relatives and family members.
According to the reports, one of the certificates was used to provide Maulana with outside food and another one was presented for the bail plea. The Gujarat High Court has ruled both of the certificates to be false and untrue.
Under the Indian Medical Council Etiquette and Ethics Regulation, 2022, on August 11, the Gujarat High Court ordered GMC to take action against Dr. Rajnish for professional misconduct.
The court stated in its order that on many occasions, influential and rich criminals pay doctors to write false medical certificates so that they can stay in hospitals and get premium treatment even when they are not sick.
If a doctor issues a certificate that is unclear, inaccurate, or misleading, and no action is taken by the court against such conduct, it can have adverse consequences for society," the court stated.
Dr. Rajnish and his lawyers argued that a court that is hearing another case or a bail application cannot give orders to GMC to take action against a doctor, as this is not allowed by the court’s jurisdiction.
Justice M R Mengdey considered the doctor’s petition, and the next hearing is scheduled to be on Jan 6, 2027.
