Haryana Doctor Ordered to Pay 2 lakh Compensation over Medical Negligence in Kidney Surgery.

A Haryana doctor is being held negligent in a kidney stone surgery after the patient developed blood clots, bleeding, and urinary blockage post the surgery,

​On August 12, the commission directed the doctor’s insurer to pay the complainant an amount of Rs 2 lakh.

According to the commission, Gurjit Singh had his left kidney stone treated on March 12, 2023, and then he was admitted again on March 26 for another procedure. On March 28, Gurjit was discharged, but he developed urinary bleeding soon after. However, even after informing the doctor, he was not provided with any medical help.

​Singh was admitted in the hospital on April 6 when he developed blood clots in his urinary tract and remianed under medical supervision. On April 7, he was refferred to Batra Hospital and Medical Research Centre in Delhi.

​During his treatment at Batra Hospital, an angiography indicated that he had a huge false aneurysm in the branch of the kidney. Doctors performed an embolisation procedure on him, and he was discharged within a day.

In his complaint, Gurjit alleged that during his first surgery, the doctor had damaged one of his blood vessels and did not provide him with proper medical care to treat the bleeding.

​The doctor has completely denied any medical negligence towards the case. According to reports by TOI, Gurjit was already informed about the risks and complications involved post kidney surgery. The doctor also mentioned giving Gurjit proper treatment and medical help whenever he encountered a problem and that he was also referred to another doctor for better treatment options.

The bench comprised of Jaswant Singh, Neeru Agrawal and Sarvjeet Kaur who found discrepancies in Gurjit’s  According to them his discharge summaries mentioned RIRS being performed on him, but in the referral summary it was mentioned that he has gone through PCNL and DJ stenting

​Gurjit’s condition has gone worse post his surgery, and he clearly needed better medical help, the commission mentioned.

​The commission also rejected the doctor’s argument that expert evidence was required to prove negligence.

​Gurjit was awarded compensation of 2 lakh rupees instead of his original demand of 50 lakh, which the court quoted as an excessive demand. The doctor is asked to pay the amount whin 45 days or else an interest of 9 percent will be added to the original compensation amount.
