Army Doctor Accused of Insulting Patient's Modesty; Court Martial Scheduled

A General Court Martial (GCM) is being considered for an Indian Army doctor who is accused of insulting a Major's wife's modesty during a medical examination. According to Army officials, the court martial of the Lieutenant Colonel ranked officer, who is assigned as a medical expert at Military Hospital, Ahmednagar, Maharashtra, is nearing its conclusion.

The Mechanized Infantry Centre and School, Ahmednagar, Maharashtra. is the site of the trial. According to sources, the doctor has contended that he is innocent and that he examined the patient who reported having chest problems in a professional manner.

The doctor is accused of two crimes. The first accusation is that, on June 10, 2022, he unlawfully forced his way into the hospital to examine the Major's wife's chest with the intention of insulting her modesty. This concerns the act of violating Section 354 of the Indian Penal Code (IPC) by committing a civil offense or by utilizing unlawful force against a lady with the intention of offending her modesty.

The officer is also accused of a second offense related to omissions that compromise military discipline and good order. According to Paragraph 51 of the Defence Services Regulations (Regulations for the Medical Services of the Armed Forces – 2010), the doctor is charged with failing to ensure the presence of a nurse or a woman attendant during the examination.

Regulations stipulate that an attendant must be present during the examination of a female patient.
