Kavita Devi claims she underwent surgery at KMC Hospital in May 2017 for internal organ repair after being assured by Dr. Sunil Gupta that the procedure would improve her health. However, Devi reported that her health deteriorated significantly after the surgery. Years later, multiple ultrasound scans revealed that one of her kidneys was missing.
According to Devi, the hospital staff misled her by providing false ultrasound reports and actively discouraged her from seeking second opinions. She further accused the doctors of threatening her family and destroying her medical records to conceal the unauthorized organ removal.
The aftermath of the surgery severely impacted Devi’s livelihood, leaving her unable to work. Her family has reportedly fallen into a debt of ₹10 lakh, forcing them to mortgage their home to cover medical expenses and legal fees.
After several unsuccessful attempts to file a police complaint, the Additional Chief Judicial Magistrate (ACJM) III court intervened, ordering the registration of an FIR. The accused face serious charges under the following sections:
IPC Section 120B: Criminal conspiracy
IPC Section 326: Voluntarily causing grievous hurt by dangerous means
IPC Section 506: Criminal intimidation
Section 18 of the Transplantation of Human Organs and Tissues Act, 1994: Involvement in illegal organ trade
