In a shocking development, a local court has directed the registration of an FIR against six doctors from KMC Hospital, Meerut, following allegations by a 43-year-old woman, Kavita Devi, that her kidney was removed without consent during a surgery in 2017.

Allegations of Unauthorized Kidney Removal

Kavita Devi claims she underwent surgery at KMC Hospital in May 2017 for internal organ repair after being assured by Dr. Sunil Gupta that the procedure would improve her health. However, Devi reported that her health deteriorated significantly after the surgery. Years later, multiple ultrasound scans revealed that one of her kidneys was missing.

Claims of Cover-Up and Intimidation

According to Devi, the hospital staff misled her by providing false ultrasound reports and actively discouraged her from seeking second opinions. She further accused the doctors of threatening her family and destroying her medical records to conceal the unauthorized organ removal.

Financial and Emotional Toll

The aftermath of the surgery severely impacted Devi’s livelihood, leaving her unable to work. Her family has reportedly fallen into a debt of ₹10 lakh, forcing them to mortgage their home to cover medical expenses and legal fees.

Legal Action and Charges

After several unsuccessful attempts to file a police complaint, the Additional Chief Judicial Magistrate (ACJM) III court intervened, ordering the registration of an FIR. The accused face serious charges under the following sections:

  • IPC Section 120B: Criminal conspiracy

  • IPC Section 326: Voluntarily causing grievous hurt by dangerous means

  • IPC Section 506: Criminal intimidation

  • Section 18 of the Transplantation of Human Organs and Tissues Act, 1994: Involvement in illegal organ trade

Doctors Named in the FIR

The FIR specifically names six doctors from KMC Hospital:

  • Dr. Sunil Gupta (Hospital Owner)

  • Dr. Ajay N Vats

  • Dr. Satish Arora

  • Dr. Seema Vashney

  • Dr. Pratibha Gupta

  • Dr. Nikita Jaggi

Statements from Both Sides

Kavita Devi detailed the threats against her family and the extent of her health decline following the surgery.

Dr. Sunil Gupta has strongly denied the allegations, labeling them as fraudulent and an attempt at extortion. He argued that earlier police inquiries found no merit in Devi's claims, prompting her to pursue the matter through the court.

Paritosh Teotia, Devi's lawyer, criticized law enforcement for the repeated delays and the humiliation his client endured while seeking justice.

Chandgiram Singh, the station in-charge, confirmed that an investigation is now underway.

Broader Concerns Over Medical Ethics

This case has sparked serious concerns over patient safety and medical ethics. The alleged violation of the Transplantation of Human Organs and Tissues Act, 1994, highlights potential lapses in regulatory enforcement and raises questions about the accountability of healthcare professionals.

Ongoing Investigation

Authorities have assured that a thorough investigation will be conducted to uncover the facts. The case is being closely monitored as it has broader implications for medical accountability and the enforcement of ethical practices in healthcare institutions.
