Bengaluru: The Karnataka High Court directed a doctor from Chigateri Hospital, Davangere, to file an affidavit explaining the treatment provided to Manjunath on April 14, 2023.

The court directed the state government to obtain an affidavit from a doctor at Chigateri District Hospital, Davangere.

The certificate is for the second wound certificate issued to the complainant in case of an assault.

The case

According to the petitioner advocates Manjunath the complainant, a resident of Bhadravati in Shivamogga had assaulted them. Manjunath had several cases about matrimonial disputes and Advocate Ramdas and his office had represented his wife.

In 2023 Manjunath had complained and alleged that the advocates had assaulted him. The police then filed the charges for offenses against IPC sections 320, 323, and 325.

Advocates complained Manjunath had been targeting them since they appeared for his wife.

The court had noted that the foundation for filing the charges -assault is an injury suffered by the complainant. The petitioner, Manjunath after being examined at a hospital in Bhadravathi on the day of the incident had no external injuries. Not satisfied with the certificate filed by the doctors with their General Hospital, Bhadravathi Manjunath traveled to Davangere and got a second certificate from a government doctor at Chigateri District Hospital.

Surprisingly, the picture of the wound presented barely 12 hours later was completely different from the present one. The second wound certificate depicted several bruises and injuries on the body. The first wound certificate was secured on April 13, 2023, and the second was obtained on May 22nd, 2023.

Justice Naga Prasanna observed that the prima facie registration of the crime was a camouflage. He said the case was registered solely to defame the petitioners representing his wife.

The Karnataka High Court directed a doctor from Chigateri Hospital, Davangere, to file an affidavit explaining the treatment provided to Manjunath on April 14, 2023. The doctor issued a medical certificate on May 22, 2023, reporting injuries and bruises, which conflicted with an earlier certificate stating no external injuries. The court instructed the state to obtain the affidavit by the following day and scheduled the next hearing for January 24, 2025.
